1. Acceptance of these Terms

These Terms of Service (“Terms”) are a binding agreement between you and 15sec (“15sec,” “we,” “us,” or “our”). They govern your access to and use of 15sec and our creator experiment, routing, analytics, and related services (collectively, the “Service”).

By accessing the Service, creating an account, connecting a channel, or clicking to continue, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind it, and “you” includes that organization.

2. Eligibility

You must be at least 18 years old and legally capable of entering a contract to use the Service. The Service is intended for creators, businesses, and professional users and is not directed to children. You may not use the Service if applicable law prohibits you from doing so.

3. The Service

15sec helps eligible YouTube creators configure video-variant experiments, distribute test links, compare routed-view and YouTube performance data, and review automated or AI-assisted insights. Some features may be labeled beta, pre-release, testing, or experimental.

We may add, remove, suspend, or modify features. We do not promise that every feature will always be available, that every video will be eligible, or that use of the Service will improve views, retention, revenue, subscribers, or any other result.

4. Accounts and security

You must provide accurate information, maintain control of your Google and 15sec accounts, and promptly notify us of unauthorized access. You are responsible for activity under your account and for ensuring that anyone who uses it complies with these Terms. You may not share access in a way that bypasses plan limits or impersonate another person or organization.

5. Google and YouTube services

The Service uses YouTube API Services and Google authentication. By using YouTube-enabled features, you agree to be bound by the YouTube Terms of Service. You should also review the Google Privacy Policy. Your use of YouTube and Google remains governed by your agreements with those providers.

When you connect a channel, you authorize the Service to access the channel and data covered by the permissions displayed by Google. We use those permissions only to provide the features described at the time of authorization and in our Privacy Policy. A write-enabled permission may be used only for an action you request or expressly enable, such as a supported publishing action. You can disconnect a channel in the Service or revoke access through your Google security permissions.

Disconnecting a channel or deleting information stored by 15sec does not delete videos, channels, or other information stored by YouTube. To delete information on YouTube, use YouTube itself or another authorized application that supports the requested deletion.

You represent that you own or are authorized to administer every channel you connect. You may not connect another party’s channel or use YouTube data beyond the permissions and purposes authorized by its owner.

6. Your content

“Your Content” means videos, audiovisual files, titles, thumbnails, instructions, experiment names, feedback, and other material you submit or make available through the Service. As between you and 15sec, you retain ownership of Your Content.

You grant us a limited, non-exclusive, worldwide license to host, copy, transmit, display, analyze, and otherwise process Your Content only as necessary to operate, secure, support, and improve the user-facing Service for you. This license allows us to use service providers to process content on our behalf. It ends when the content is deleted from our active systems, subject to limited backups, legal retention, and content incorporated into aggregated or de-identified information.

You represent and warrant that:

  • you own or have all rights, permissions, and consents needed for Your Content and our processing of it;
  • Your Content and your use of the Service do not infringe intellectual property, privacy, publicity, contractual, or other rights;
  • you will not submit unlawful, deceptive, harmful, or malicious material; and
  • you will comply with YouTube policies and any agreements applicable to your channel and content.

7. Acceptable use

You may not, and may not help another person to:

  • access a channel, account, video, or data without authorization;
  • manipulate views, engagement, metrics, routing counts, or experiment results, or use bots, click farms, or deceptive traffic;
  • violate law, the YouTube Terms of Service, Google policies, or a third party’s rights;
  • upload malware, probe or disrupt the Service, bypass security or rate limits, or interfere with another user;
  • scrape, harvest, or export YouTube data except through supported Service features and for an authorized purpose;
  • reverse engineer or attempt to discover non-public source code, models, systems, or methods, except where law expressly permits it;
  • resell, sublicense, or provide the Service to third parties unless we authorize it in writing;
  • use the Service or output to create or improve a competing service or general-purpose machine-learning model; or
  • use the Service for surveillance, discrimination, credit or lending decisions, unlawful profiling, or personalized advertising based on Google or YouTube user data.

8. Experiments, test links, and publishing

You control where you distribute test links and are responsible for ensuring that your distribution, disclosures, and content comply with law and platform rules. Test links may use a random identifier and short-lived assignment cookies to keep routing consistent and measure routed views, as explained in our Privacy Policy.

Routing, caps, analytics, and results can be delayed, incomplete, or affected by bots, blocked storage, YouTube reporting changes, network conditions, or other factors outside our control. 15sec results are directional tools, not an audited measurement service.

If you enable an automatic or scheduled publishing feature, you instruct us to take the described action when its stated conditions are met. You remain responsible for reviewing the setting, maintaining backups, and confirming the resulting channel state. You can disable the feature before execution, subject to reasonable processing delay.

9. Analytics and AI output

Analytics, recommendations, segment labels, summaries, predictions, and other automated output may be inaccurate, incomplete, or unsuitable for your circumstances. They are provided for informational purposes and do not constitute legal, financial, advertising, or professional advice. You are responsible for reviewing output and for decisions you make based on it.

Do not submit confidential, regulated, or highly sensitive information unless the feature expressly supports it and you are authorized to do so. You acknowledge that third-party AI and infrastructure providers may process inputs and outputs as described in our Privacy Policy.

10. Complimentary experiments, billing, and cancellation

Paid plans are billed in advance on a recurring basis at the price, currency, interval, and taxes shown at checkout. Unless you cancel, your subscription automatically renews at the end of each billing period and you authorize Stripe to charge your selected payment method. Prices may change with advance notice, with the change generally taking effect at a later renewal.

We may offer a complimentary experiment or other promotion under the terms displayed when it is offered. A complimentary experiment does not require a payment method and does not automatically convert into a paid subscription. You can manage or cancel a paid plan through the billing portal in account settings. Cancellation normally takes effect at the end of the current paid period unless the checkout terms or applicable law say otherwise.

Except where law requires otherwise or we expressly state otherwise, payments are non-refundable and partial billing periods are not prorated. You are responsible for applicable taxes other than taxes on our income. Failed or reversed payments may result in restricted or suspended access.

11. Third-party services

The Service depends on third-party services, including Google, YouTube, Supabase, Stripe, Vercel, and Upstash. We do not control their services, terms, policies, availability, or decisions. A provider may change or discontinue an API or feature, which may cause corresponding Service features to change or stop working. We are not responsible for third-party sites or services, except to the extent required by law.

12. 15sec intellectual property

The Service, including its software, design, text, graphics, branding, methods, and non-user content, is owned by 15sec or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose during your authorized subscription or access period. No other rights are granted.

13. Feedback

If you provide ideas or feedback about the Service, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation. This does not transfer ownership of Your Content or permit us to identify you publicly without permission.

14. Suspension and termination

You may stop using the Service at any time and may delete your account in account settings. Account deletion may cancel an active subscription and remove experiments and analytics as described in the Service and Privacy Policy.

We may restrict, suspend, or terminate access if you materially or repeatedly violate these Terms, create security or legal risk, fail to pay, misuse Google or YouTube data, or if needed to comply with a provider requirement or law. Where practical, we will provide notice and an opportunity to cure. We may immediately act where delay could cause harm, expose data, or violate law or provider policy.

Sections that by their nature should survive termination, including ownership, payment obligations, disclaimers, limitations, indemnity, and dispute terms, will survive.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” 15SEC DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant any experiment result, recommendation, audience response, platform outcome, data availability, or preservation of content. Nothing in these Terms excludes a warranty or right that applicable law does not allow to be excluded.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 15SEC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR CHANNEL PERFORMANCE, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID 15SEC FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

These limitations do not apply to liability that cannot legally be limited, and they do not reduce mandatory consumer rights.

17. Indemnification

To the extent permitted by law, if you use the Service for a business or organization, you will defend and indemnify 15sec and its affiliates, officers, employees, and contractors against third-party claims, damages, losses, and reasonable legal fees arising from Your Content, your connected channels, your violation of these Terms, or your infringement of another party’s rights. We will provide reasonable notice and cooperation and will not settle a claim imposing a non-monetary obligation on you without your consent.

18. Governing law and disputes

Before filing a formal claim, you agree to contact support@15sec.app and try in good faith for 30 days to resolve the dispute informally.

Except where mandatory law provides otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any court proceeding must be brought in a state or federal court with jurisdiction in California, and each party consents to personal jurisdiction there. This section does not prevent either party from seeking urgent injunctive relief or using an eligible small-claims process.

20. Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised Terms and update the date above. For material changes, we will provide reasonable advance notice when required. Continued use after the effective date means you accept the revised Terms; if you do not agree, you must stop using the Service and cancel any subscription.

21. General terms

These Terms and the Privacy Policy are the entire agreement about the Service unless separate written terms apply. If a provision is unenforceable, it will be modified only as much as necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, acquisition, or transfer of the Service. Neither party is liable for delay caused by events beyond reasonable control. Headings are for convenience only.
